In both official registries: the Chambre des notaires du Québec and the Barreau du Québec
The Declarant hereby appoints and constitutes, as of this day, Azur Média Inc., doing business as “DOCUGO service de recherches” (hereinafter the “Agent”), as attorney-in-fact mandated to carry out, on my behalf, testamentary searches with the Chambre des notaires du Québec and the Barreau du Québec, for the deceased person identified in the testamentary search request completed by the Declarant. The Agent’s mandate is thus limited to obtaining the certificate of testamentary search from the Chambre des notaires du Québec and the certificate of search from the Barreau du Québec (collectively referred to as the “Certificates” and individually as a “Certificate”). For any legal questions (notably, relating to the estate, such as acceptance or renunciation), the Agent recommends that the Declarant consult a notary.
The testamentary search request submitted to the Chambre des notaires du Québec and the Barreau du Québec will be based on the information provided by the Declarant. Therefore, the Agent (including its directors, representatives, employees, etc.) cannot be held liable for any error in either Certificate, particularly when such error results from missing or incorrect information in the search request, or from any error not attributable to the negligence of the Agent.
The Declarant also authorizes the Agent, by the present document, to communicate, if necessary, with any representative of the Chambre des notaires du Québec and/or the Barreau du Québec, for example, to provide clarifications or respond to inquiries relating to the testamentary search request. The Declarant authorizes the Agent to include the Declarant’s name in said testamentary search requests.
For informational purposes, the Chambre des notaires du Québec and the Barreau du Québec will not provide us with a will, but rather with a “certificate of search” indicating whether a will is registered in the registry. If so, the Certificate will include the contact information of the notary or lawyer who holds the will.
The Agent will forward the Certificates to the Declarant as soon as possible, according to the method of transmission requested by the Declarant. Please note that the Agent is not responsible for processing delays on the part of the Chambre des notaires du Québec or the Barreau du Québec.
