As part of its activities, DOCUGO may<br\/>collect, use, disclose, retain and destroy certain personal information. <\/p><p>This policy aims to clearly explain how DOCUGO protects the personal information<br\/>entrusted to it, in accordance with the laws applicable in Quebec, including the<br\/><em>Act respecting the protection of personal information in the private sector<\/em>.<\/p><h2>1. Purpose of the policy<\/h2><p>This policy is intended to inform clients, website visitors, suppliers, employees, candidates,<br\/>consultants and any other concerned person about:<\/p><ul><li>the types of personal information that DOCUGO may collect;<\/li><li>the purposes for which this information is collected and used;<\/li><li>the persons or organizations to whom this information may be disclosed;<\/li><li>the security measures in place to protect it;<\/li><li>the rights of the persons concerned;<\/li><li>how to contact the person in charge of personal information protection.<\/li><\/ul><h2>2. Scope<\/h2><p>This policy applies to personal information collected by DOCUGO in the course of its activities,<br\/>including through:<\/p><ul><li>the website <strong>docugo.ca<\/strong>;<\/li><li>online forms;<\/li><li>communications by phone, email or any other electronic means;<\/li><li>documents sent by clients or authorized third parties;<\/li><li>payment or billing transactions;<\/li><li>relationships with suppliers, employees, candidates and consultants.<\/li><\/ul><p>It also applies to officers, employees, consultants, agents, service providers and any<br\/>other person who processes personal information on behalf of DOCUGO.<\/p><h2>3. Definitions<\/h2><p><strong>Personal information<\/strong> is any information about a natural person that allows that person to be identified,<br\/>directly or indirectly. This may include, for example, a name, address, email address,<br\/>phone number, date of birth, financial information, information relating<br\/>to a death, or a document that makes it possible to identify a person. <\/p><p><strong>Sensitive personal information<\/strong> is information that, due to its nature or the context of its<br\/>use or disclosure, gives rise to a high degree of reasonable expectation of privacy. This may<br\/>include, for example, financial, medical, legal, estate, identification or any<br\/>other confidential information. <\/p><p><strong>Business contact information<\/strong>, such as a person\u2019s name, title, position, business address, business<br\/>email address or business phone number, is generally not considered<br\/>personal information when it relates to the performance of a role within a business.<\/p><h2>4. Personal information collected<\/h2><p>DOCUGO collects only the personal information necessary to provide its services, manage<br\/>its files, comply with its legal obligations and improve its operations.<\/p><p>Depending on the nature of the file or the relationship with DOCUGO, the information collected may include:<\/p><ul><li>first and last name;<\/li><li>mailing address;<\/li><li>email address;<\/li><li>phone number;<\/li><li>language of communication;<\/li><li>information related to a service request;<\/li><li>information related to an estate or a will search;<\/li><li>name of the deceased;<\/li><li>date of birth and date of death, when necessary;<\/li><li>documents provided by the client or an authorized person;<\/li><li>billing and payment information;<\/li><li>communication history;<\/li><li>IP address, cookies and browsing data;<\/li><li>any other information necessary to carry out the requested service.<\/li><\/ul><p>DOCUGO does not knowingly collect unnecessary personal information. If personal information<br\/>is no longer required for the intended purposes, DOCUGO ensures that it is destroyed, anonymized or retained only<br\/>when required by law. <\/p><h2>5. Purposes of collection and use<\/h2><p>DOCUGO may use the personal information collected for the following purposes:<\/p><ul><li>provide the services requested by the client;<\/li><li>open, process, monitor and complete a file;<\/li><li>carry out the required administrative or estate procedures;<\/li><li>communicate with the client or an authorized person;<\/li><li>verify a person\u2019s identity or authorization when necessary;<\/li><li>submit requests, forms or documents to the relevant organizations or professionals;<\/li><li>issue invoices, receive payments and manage accounting;<\/li><li>respond to questions, requests for information or complaints;<\/li><li>comply with applicable legal, tax, accounting or regulatory obligations;<\/li><li>improve the website, services and customer experience;<\/li><li>prevent fraud, errors, privacy incidents or unauthorized use.<\/li><\/ul><h2>6. Consent<\/h2><p>In general, DOCUGO collects personal information directly from the person concerned or<br\/>from a person authorized to act on their behalf. By voluntarily providing personal information to DOCUGO,<br\/>the person concerned consents to its collection, use and disclosure for the purposes set out in<br\/>this policy or at the time of collection. <\/p><p>Where required by law, DOCUGO will request express consent, including for the use or disclosure<br\/>of sensitive personal information.<\/p><p>A person may withdraw their consent, subject to applicable legal, contractual or administrative<br\/>restrictions. However, withdrawing consent may prevent DOCUGO from providing certain services or completing<br\/>a file. <\/p><h2>7. Collection from third parties<\/h2><p>In certain cases, DOCUGO may receive or collect personal information from third parties, including when<br\/>such information is necessary to process a file or complete a procedure requested by the client.<\/p><p>These third parties may include, depending on the context:<\/p><ul><li>a person authorized by the client;<\/li><li>a family member or legal representative;<\/li><li>a notary, lawyer or other professional;<\/li><li>a public or para-public body;<\/li><li>a provider of technology, payment, delivery or hosting services;<\/li><li>any other third party where permitted by law or where consent has been obtained.<\/li><\/ul><p>When personal information is not collected directly from the person concerned, that person may<br\/>ask DOCUGO for the source of the information, subject to the exceptions provided by law.<\/p><h2>8. Disclosure of personal information<\/h2><p>DOCUGO does not sell personal information. However, DOCUGO may disclose certain personal information<br\/>to third parties when necessary to provide its services, comply with a legal obligation or protect its<br\/>rights. <\/p><p>Personal information may be disclosed to the following categories of third parties, among others:<\/p><ul><li>organizations or institutions involved in a will search or administrative request;<\/li><li>notaries, lawyers or professionals mandated or involved in the file;<\/li><li>payment service providers;<\/li><li>web hosting, email, cloud storage or technology providers;<\/li><li>administrative, accounting or professional service providers;<\/li><li>public bodies when required by law;<\/li><li>competent authorities in the event of a legal obligation, fraud, litigation or security incident.<\/li><\/ul><p>When DOCUGO entrusts personal information to a service provider, DOCUGO takes<br\/>reasonable measures to ensure that the information is used only for the intended purposes and is protected<br\/>adequately.<\/p><h2>9. Payment providers and technology services<\/h2><p>DOCUGO may use payment providers or external technology platforms to process<br\/>certain transactions, communications or online requests.<\/p><p>Depending on the services used, these providers may include:<\/p><ul><li><strong>Stripe<\/strong> \u2014<br\/><a href=\"https:\/\/stripe.com\/fr-ca\/privacy\" target=\"_blank\" rel=\"noopener\">Stripe Privacy Policy<\/a><\/li><li><strong>Clover<\/strong> \u2014<br\/><a href=\"https:\/\/www.clover.com\/ca\/fr\/privacy-policy\" target=\"_blank\" rel=\"noopener\">Clover Privacy Policy<\/a><\/li><li><strong>Global Payments<\/strong> \u2014<br\/><a href=\"https:\/\/www.globalpayments.com\/fr-ca\/confidentialite\" target=\"_blank\" rel=\"noopener\">Global Payments Privacy Policy<\/a><\/li><\/ul><p>Payment information, such as credit card numbers, is generally processed directly by secure<br\/>payment providers. DOCUGO does not store full credit card numbers, unless otherwise indicated<br\/>or required by applicable law. <\/p><h2>10. Disclosure outside Quebec<\/h2><p>Some personal information may be hosted, processed or disclosed outside<br\/>Quebec, including when DOCUGO uses cloud, payment, email,<br\/>web analytics or hosting service providers whose servers are located elsewhere in Canada or abroad.<\/p><p>Where required by law, DOCUGO takes reasonable measures to assess the risks associated with this<br\/>disclosure and to ensure that personal information receives adequate protection.<\/p><h2>11. Cookies and similar technologies<\/h2><p>DOCUGO\u2019s website may use cookies, as well as other<br\/>similar technologies.<\/p><p>These cookies may be used, among other things, to:<\/p><ul><li>ensure the website functions properly;<\/li><li>remember certain browsing preferences;<\/li><li>analyze website usage;<\/li><li>improve content, performance and user experience;<\/li><li>measure the effectiveness of certain advertising campaigns or digital communications.<\/li><\/ul><p>Visitors can configure their browser to refuse or delete certain cookies. Security of personal information<\/h2><p>DOCUGO implements reasonable security measures to protect the personal information it<br\/>holds against loss, theft, unauthorized access, unauthorized use, unauthorized disclosure,<br\/>unauthorized modification or unauthorized destruction.<\/p><p>These measures may include, among other things:<\/p><ul><li>limiting access to personal information to only those who need access;<\/li><li>the use of passwords, permissions and controlled access;<\/li><li>reasonable IT security measures;<\/li><li>internal procedures for managing documents and files;<\/li><li>staff awareness of confidentiality;<\/li><li>secure destruction of information when it is no longer needed.<\/li><\/ul><p>Despite the measures in place, no technological system can be guaranteed to be completely secure.<br\/>However, DOCUGO undertakes to take reasonable measures proportionate to the sensitivity of the information<br\/>processed.<\/p><h2>14. Retention and destruction of personal information<\/h2><p>DOCUGO retains personal information only for as long as necessary to achieve the purposes for<br\/>which it was collected, or for the period required by applicable laws, including tax,<br\/>accounting, administrative or legal requirements.<\/p><p>When personal information is no longer necessary, DOCUGO ensures that it is destroyed securely,<br\/>anonymized or retained only when permitted or required by law.<\/p><h2>15. Privacy incidents<\/h2><p>A privacy incident may include unauthorized access, unauthorized use, unauthorized disclosure,<br\/>loss or any other breach of the protection of personal information.<\/p><p>In the event of a privacy incident, DOCUGO takes reasonable measures to limit the risk of harm<br\/>and prevent such an incident from recurring.<\/p><p>Where required by law, DOCUGO will notify the Commission d\u2019acc\u00e8s \u00e0 l\u2019information du Qu\u00e9bec and the persons<br\/>concerned if the incident presents a risk of serious harm. DOCUGO also keeps a register of privacy incidents<br\/>in accordance with applicable requirements. <\/p><h2>16. Rights of the persons concerned<\/h2><p>Subject to the exceptions provided by law, any person concerned may exercise certain rights with respect<br\/>to their personal information, including:<\/p><ul><li>request access to the personal information that DOCUGO holds about them;<\/li><li>request the correction of inaccurate, incomplete or ambiguous personal information;<\/li><li>withdraw their consent to certain uses or disclosures;<\/li><li>request information about the categories of persons who have access to their information;<\/li><li>request the applicable retention period;<\/li><li>request that dissemination cease or that information be de-indexed, where the conditions provided by law are met;<\/li><li>request the portability of certain computerized personal information, where this right applies.<\/li><\/ul><p>Any request must be submitted in writing to DOCUGO\u2019s person in charge of personal information protection,<br\/>using the contact information provided below.<\/p><p>DOCUGO will respond to requests within the time limits provided by law. Where a request is refused, in whole or in part,<br\/>DOCUGO will explain the reasons for the refusal, subject to applicable restrictions. <\/p><h2>17. Handling complaints<\/h2><p>Any person who wishes to file a complaint regarding the protection of their personal information or<br\/>the application of this policy may contact DOCUGO\u2019s person in charge of personal information<br\/>protection in writing.<\/p><p>The complaint must include, as far as possible:<\/p><ul><li>the name of the person concerned;<\/li><li>their contact information;<\/li><li>the subject of the complaint;<\/li><li>a description of the facts or concerns;<\/li><li>any document or information useful for analyzing the complaint.<\/li><\/ul><p>DOCUGO will handle any complaint confidentially and within a reasonable time.
